These Terms of Business govern your access to and use of hawktradingeducation.com and all associated services operated by Hawk Trading Education Pty Limited (ABN 53 651 107 158). By accessing the website or using our services, you agree to be bound by these Terms.

1. Introduction and Acceptance

These Terms of Business ("Terms") govern your access to and use of the website hawktradingeducation.com and any associated services operated by Hawk Trading Education Pty Limited (ABN 53 651 107 158) ("Hawk", "we", "us", "our"). By accessing the website, registering for The Campus, purchasing a paid indicator, or otherwise using our services, you agree to be bound by these Terms.

These Terms apply to all visitors and users of the website. Where you engage with Hawk as a regulated Introducing Broker Partner, separate partnership terms negotiated individually with Hawk will govern that relationship and will take precedence over these Terms in the event of any conflict.

If you do not agree to these Terms, you must not use the website or any associated services.

2. Who We Are and What We Do

Hawk Trading Education Pty Limited is a Brisbane, Queensland based financial technology education company. Hawk:

  • Publishes educational content relating to systematic, multi-instrument Contracts for Difference (CFD) trading methodology
  • Develops and licenses proprietary trading indicators, available for free and for purchase, for use on the TradingView platform
  • Operates a business-to-business signal licensing arrangement, under which the Hawk Divitiae Strategy generates trading signals delivered exclusively to the funded master accounts of regulated Introducing Broker Partners located outside Australia via the Automated Trade Execution Bridge
  • Operates a community membership platform, The Campus, accessible via Discord, with free and paid membership tiers

Hawk Trading Education Pty Limited does not hold an Australian Financial Services (AFS) licence and is not licensed to provide financial product advice. Hawk does not provide personal financial advice to any individual, does not consider any individual's personal financial circumstances, objectives, or needs, and does not manage funds or trading accounts on behalf of any client, member, or visitor.

Hawk's signal licensing services are provided exclusively to regulated Introducing Brokers located outside Australia who hold appropriate licences in their own jurisdictions. Hawk does not provide trading signals, copy trading services, or automated execution services directly to retail individuals. Any retail client who accesses copy trading services does so through, and as a client of, a properly licensed Introducing Broker - not Hawk.

3. Educational Purpose Only - No Financial Advice

All content published by Hawk, including but not limited to website content, indicator descriptions, strategy commentary, performance methodology disclosures, and content within The Campus community, is provided for general educational and informational purposes only.

Nothing on this website or within The Campus constitutes:

  • A recommendation or solicitation to buy, sell, or hold any financial product
  • Personal financial advice tailored to your individual circumstances
  • An offer, invitation, or inducement to engage in any financial product transaction
  • A guarantee or representation as to future trading performance or outcomes

Content reflects general principles and methodology only. It does not take into account your personal objectives, financial situation, or needs. Before acting on any information provided by Hawk, you should consider its appropriateness to your own circumstances and seek independent financial, legal, or taxation advice from an appropriately licensed professional.

Trading derivatives, including Contracts for Difference, carries significant risk of loss. Past performance, including any backtested or live verified performance data published by Hawk, is not indicative of future results. You may lose some or all of your invested capital. You should not engage in CFD trading unless you understand and accept these risks.

4. Eligibility

You must be at least 18 years of age to use this website, register for The Campus, or purchase any product from Hawk. By using the website or registering for any service, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

Hawk reserves the right to refuse registration, membership, or service to any individual at its sole discretion, including where Hawk reasonably believes a person does not meet eligibility requirements or where registration would expose Hawk to regulatory or reputational risk.

5. The Campus Community Membership

The Campus is Hawk's invitation and application based community, accessed via Discord, comprising free and paid membership tiers as published on the website from time to time.

  • Free tier (Undergrad Member): access to community discussion, free Pine Script indicators, and general educational content.
  • Paid tier(s): additional benefits as described on the website at the time of purchase, which may include advanced tools, priority indicator access, and input into the development roadmap.

Membership of The Campus is also governed by Hawk's separate Member Terms of Participation, available at /member-terms. Where there is any conflict between these Terms and the Member Terms of Participation specifically regarding community conduct, the Member Terms of Participation govern. Members must not provide personal financial advice to other members. All community discussion is educational and informational only.

Paid Campus membership is billed on a subscription basis as described at checkout. Section 9 (Pricing, Payment, and Refunds) applies to all paid Campus tiers.

7. Intellectual Property

All content on this website, including text, graphics, logos, the Hawk brand, the Strix character and associated artwork, indicator code, strategy documentation, and the Hawk Divitiae Strategy methodology, is the intellectual property of Hawk Trading Education Pty Limited or its licensors, and is protected by Australian and international intellectual property laws.

Hawk discloses general information about the Hawk Divitiae Strategy's approach and philosophy for transparency purposes. Hawk does not disclose, and these Terms do not grant you any right to obtain, the specific indicators used, parameter values, scoring methodology, combination logic, or underlying source code of the Hawk Divitiae Strategy. These elements constitute Hawk's confidential and proprietary intellectual property.

You may not copy, reproduce, republish, distribute, or create derivative works from any content on this website without Hawk's prior written consent, except as expressly permitted under a specific product licence (such as a paid indicator licence under Section 6).

8. Performance Data and Verification

Where Hawk publishes performance data, backtest results, or verification methodology (including on the Hawk Divitiae Strategy page and within The Innovation Centre), this data is provided for transparency and due diligence purposes only.

  • Backtest results are generated using historical market data and do not represent actual trading or guarantee future results.
  • Where live verified results are presented, the verification methodology is disclosed alongside the data.
  • All performance data is presented with applicable caveats regarding risk, drawdown, and the limitations of past performance as an indicator of future performance.
  • Performance data must not be relied upon as a representation that any individual will achieve similar results.

9. Pricing, Payment, and Refunds

Prices for paid products (including Campus membership tiers and paid indicators) are displayed in the currency and amount stated on the website at the time of purchase, inclusive of any applicable taxes unless stated otherwise.

Your rights under Australian Consumer Law are not affected by anything in these Terms. Where you are a "consumer" for the purposes of the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)), our digital products and services come with guarantees that cannot be excluded. If a paid indicator or Campus membership fails to be of acceptable quality, or does not match its description, you may be entitled to a repair, replacement, or refund, depending on the nature of the failure.

Beyond your non-excludable consumer guarantee rights, Hawk's discretionary refund approach is as follows:

  • Paid indicators: due to the digital, immediately accessible nature of these products, refunds are not available for change of mind once access has been granted, but remain available where the product fails to meet a consumer guarantee.
  • Paid Campus subscriptions: you may cancel a recurring subscription at any time, effective from the next billing cycle. No partial refund is provided for the remainder of a current billing period, except where required by the Australian Consumer Law.

Nothing in this Section limits, excludes, or attempts to exclude any right or remedy you have under the Australian Consumer Law, and no clause in these Terms should be interpreted as a blanket "no refunds" policy overriding those rights.

10. Limitation of Liability

To the maximum extent permitted by law, Hawk excludes all liability for any indirect, special, or consequential loss, including loss of profits or trading losses, arising from your use of the website, reliance on any content, or use of any indicator or product, except to the extent such liability cannot be excluded under the Australian Consumer Law.

Where Hawk's liability cannot be wholly excluded but can be limited, Hawk's liability is limited, at Hawk's option, to the resupply of the relevant service or product, or the cost of having the relevant service or product resupplied.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted, or modified.

You acknowledge that trading decisions you make, whether informed by Hawk's educational content, indicators, or otherwise, are made at your own discretion and risk, and Hawk is not liable for any trading losses you incur.

11. Third Party Platforms and Services

Hawk's services rely on or interact with third party platforms, including TradingView and Discord. Your use of those platforms is governed by their own terms of service, over which Hawk has no control. Hawk is not responsible for the availability, performance, or conduct of these third party platforms.

Where Hawk provides signals to Introducing Broker Partners for onward copy trading, the relationship between an Introducing Broker and its retail clients is governed by the Introducing Broker's own terms, not by these Terms.

12. Termination and Suspension

Hawk may suspend or terminate your access to The Campus, any paid product, or the website, at its sole discretion, where you breach these Terms, the Member Terms of Participation, or applicable law, or where Hawk reasonably believes your conduct poses a risk to Hawk, other members, or the integrity of Hawk's services. Where reasonably practicable, Hawk will provide notice before taking such action.

Termination does not affect any consumer guarantee rights you may have in respect of products already purchased.

13. Changes to These Terms

Hawk may update these Terms from time to time to reflect changes in our services, legal obligations, or business practices. The updated version will be posted on this page with a revised date. Continued use of the website or services after changes take effect constitutes acceptance of the updated Terms. Where changes materially affect existing paid subscribers, Hawk will take reasonable steps to notify affected members.

14. Governing Law

These Terms are governed by the laws of Queensland, Australia. Any disputes arising from these Terms are subject to the exclusive jurisdiction of the courts of Queensland, Australia, without limiting any right you may have to bring a matter before a state or territory consumer protection body or tribunal under the Australian Consumer Law.

Service-Specific Addenda

The following addenda are supplementary to the General Terms of Business above and apply only to members or clients engaged with the specific Hawk service each addendum names. Each addendum governs its named service in addition to, not instead of, the General Terms.

Addendum I

Subscription Terms

These Subscription Terms apply specifically to paid Campus membership subscriptions and are supplementary to the General Terms of Business above. On matters of subscription billing, cancellation, and refund, these Subscription Terms are the specific provision and prevail over the general body. On all other matters, the General Terms of Business govern.

1. Who these terms apply to. These Subscription Terms apply to any person who subscribes to a paid Campus membership tier (CFD Member or +Options Member). Free membership is not a subscription and is governed by the General Terms of Business and the Member Terms of Participation only.

2. Membership tiers and pricing. CFD Member is A$49/month (or US$39/month, £29/month) billed monthly, or A$41.65/month (or US$33.15/month, £24.65/month) billed annually at A$499.80/year (or US$397.80/year, £295.80/year) - a 15% saving against the monthly rate. +Options Member is A$249/month (or US$179/month, £134/month) billed monthly, or A$199.20/month (or US$143.20/month, £107.20/month) billed annually at A$2,390.40/year (or US$1,718.40/year, £1,286.40/year) - a 20% saving against the monthly rate. These prices are GST-free for members receiving the service outside Australia, and inclusive of GST for members receiving the service inside Australia - GST liability is determined by the location of the recipient at the time of supply, not their billing currency. All prices are billed in advance, monthly or annually as selected at signup, in the currency selected at signup. Hawk may change subscription pricing on notice. Any change applies from the next billing cycle following that notice and does not affect the period you have already paid for.

3. Recurring billing and authority to charge. By subscribing, you authorise Hawk, through its payment processor, to charge the applicable fee to your nominated payment method on a recurring basis - monthly or annually, as selected at signup - until you cancel. Each successful payment renews your access for the following billing period.

4. Payment processing. Payments are processed by Stripe. Your card details are held by Stripe, not by Hawk. Where you elect to save your details through Link, Stripe's Link terms apply to that facility. Hawk does not store full card numbers.

5. Promotional codes. Time-limited or quantity-limited promotional codes apply on the terms stated at the point of offer. The OG10 founding member code provides a discount equal to the full CFD Member monthly price in the currency selected at signup (A$49, US$39, or £29) against recurring monthly billing - or, for members who pay annually, the pro-rata equivalent of that same monthly value applied once against the first year's payment, calculated by the number of days remaining until 31 December 2026 at the time of signup. It is limited to the first ten redemptions, applies to CFD Member and +Options Member, and expires on 31 December 2026 - no new redemptions after that date, and the discount itself does not apply beyond that date on any subscription, continuously active or not. A promotional discount applies only while the subscription remains continuously active. Cancellation ends the discount, and it cannot be reinstated. The annual pro-rata benefit applies only to the first year's payment and is never recalculated or reinstated on renewal. Codes have no cash value and may be withdrawn or amended at any time in respect of future subscriptions.

6. Cancellation. You may cancel at any time by emailing contact@hawktradingeducation.com. Cancellation takes effect at the end of the current paid billing period. You retain access until the end of that period. No partial refund is provided for the unused remainder of a billing period, except as required by the Australian Consumer Law or as provided in clause 7.

7. Seven-day cooling-off. A first-time subscriber who cancels within seven days of their first subscription payment may request a full refund of that first payment. To qualify, the member must have complied with the deletion obligation in the Member Terms of Participation in respect of any proprietary Hawk materials accessed during that period. This cooling-off refund applies once per person and does not apply to subsequent renewals or re-subscriptions. It is a discretionary Hawk policy offered in addition to, and does not limit, your rights under the Australian Consumer Law.

8. Refunds and consumer guarantees. Nothing in these Subscription Terms excludes, restricts, or modifies any consumer guarantee under the Australian Consumer Law that cannot lawfully be excluded. Outside the cooling-off policy in clause 7 and any non-excludable consumer guarantee, subscription fees are non-refundable. Change of mind after the cooling-off period is not a ground for refund.

9. Removal for breach. Where your community access is terminated for breach of the Member Terms of Participation, access ends immediately and no refund is provided for the remainder of the current paid billing period. This does not affect any non-excludable right under the Australian Consumer Law. The grounds and process for removal are set out in the Member Terms of Participation.

10. Failed payments. If a recurring payment fails, Hawk may suspend or downgrade your access until payment is resolved, and may retry the payment through the processor. Continued failure may result in cancellation.

11. Chargebacks. Raising a chargeback in respect of correctly rendered services, rather than using the cancellation and refund process above, may result in immediate suspension of access pending resolution.

12. Effect of exit on materials. On cancellation or non-renewal, your paid access ends at the close of the paid period. Your obligations in respect of proprietary Hawk materials on exit are set out in the Member Terms of Participation and survive cancellation.

13. Relationship to other terms. These Subscription Terms govern the financial and subscription relationship only. Your conduct within Hawk community environments is governed by the Member Terms of Participation.

Addendum II

Consultancy Terms

These Consultancy Terms apply to bespoke consultancy engagements provided by Hawk Trading Education, including automation and pipeline build services delivered through The Institute. They are supplementary to the General Terms of Business above.

1. Engagement by agreement. Consultancy is provided on a case-by-case basis under a separate written engagement agreement or statement of work that sets out the scope, deliverables, fees, and timing for each engagement. That agreement is the governing document for the engagement. Where it conflicts with these Consultancy Terms or the General Terms of Business, the engagement agreement prevails, followed by these Consultancy Terms, then the General Terms of Business.

2. No financial advice. Consultancy services are technical in nature. Nothing delivered under a consultancy engagement constitutes personal financial product advice, a recommendation to trade, or a guarantee of any trading or financial outcome. This applies regardless of the terms of any individual engagement agreement.

3. Deliverables and intellectual property. Ownership of, and any licence to use, a deliverable is as set out in the engagement agreement. In the absence of express provision, Hawk retains all intellectual property in its pre-existing materials, tools, methodology, and frameworks, and the client receives a non-exclusive, non-transferable licence to use the specific deliverable for its own internal purposes only.

4. Performance and reliance. Automation and pipeline deliverables are tools that operate on inputs and market conditions outside Hawk's control. Hawk does not warrant uninterrupted operation, freedom from error, or any particular performance, financial or otherwise. The client remains responsible for its own testing, monitoring, and risk management.

5. Confidentiality. Each party will keep the other's confidential information confidential and use it only for the purposes of the engagement. Any specific confidentiality provisions in the engagement agreement prevail.

6. Fees and liability. Fees, payment terms, and any expenses are as stated in the engagement agreement. Except for rights that cannot lawfully be excluded, including any applicable consumer guarantee under the Australian Consumer Law, Hawk's liability in connection with a consultancy engagement is governed by the limitation of liability provisions in the General Terms of Business and by any cap agreed in the engagement agreement.

Addendum III

Corporate and Innovation Centre Terms

These terms apply to corporate partnerships and to Innovation Centre engagements, including signal licensing and copy trading services provided to Introducing Broker Partners. They are supplementary to the General Terms of Business above.

1. Engagement by agreement. Corporate and Innovation Centre services are provided on a case-by-case basis under a separate written partnership or licensing agreement that sets out the scope, commercial terms, fees, exclusivity, and duration. That agreement is the governing document for the engagement. Where it conflicts with these terms or the General Terms of Business, the partnership agreement prevails, followed by these terms, then the General Terms of Business. This order of precedence is subject to clauses 2 and 3 below, which the partnership agreement cannot override.

2. Regulated counterparties only. Signal licensing and copy trading services are provided exclusively to regulated Introducing Brokers located outside Australia, on a business-to-business basis. They are not offered, and will not be provided, to retail clients or to any unregulated party. This requirement is a constant of every engagement and cannot be varied by an individual partnership agreement.

3. Separation from the retail community. Hawk's Innovation Centre partnerships and Hawk's educational community operate under separate commercial terms, regulatory frameworks, and access controls. Partners have no access to, and will not solicit, Hawk's community members, as set out in the Member Terms of Participation. This separation is a constant of every engagement and cannot be varied by an individual partnership agreement.

4. No retail financial advice. Services provided under these terms are provided to the partner as a business input. Nothing provided by Hawk constitutes personal financial product advice to any retail client. The partner is responsible for meeting its own regulatory obligations to its clients within its own jurisdiction.

5. Performance data. Performance figures presented in connection with these services are derived from live-forward execution, not backtested simulation, and are provided for transparency and due diligence. Past performance is not indicative of future results. Corporate Partners can access performance data via the page Performance Verification and Corporate Partner Dashboard Logins, which shows current and historic trading performance of the proprietary Hawk Divitiae algo strategy, and the health performance of the HDRFAF Pipeline, our proprietary automated trade execution bridge.

6. Intellectual property and white-label use. All intellectual property in Hawk's signals, algorithms, pipeline, and brand assets remains with Hawk. Any right to deploy Hawk's services under the partner's own brand is granted only as expressly set out in the partnership agreement and terminates with it.

7. Fees and liability. Fees, exclusivity, term, and termination are as set out in the partnership agreement. Except for rights that cannot lawfully be excluded, Hawk's liability in connection with a corporate or Innovation Centre engagement is governed by the limitation of liability provisions in the General Terms of Business and by any cap agreed in the partnership agreement.
