Community Terms of Participation

These terms govern participation in all Hawk Trading Education community environments, including online discussion platforms, live session chat rooms, forums, member groups, and any other collaborative space operated by or on behalf of Hawk.

1. Membership Eligibility

Participation in Hawk Trading Education's community environments is available to individuals who are enrolled in, or alumni of, a Hawk educational programme, or who have been granted access through a specific commercial arrangement, partnership, or invitation. Access to community spaces is not open to the general public and is extended at Hawk's sole discretion.

To be eligible for community participation, members must be aged 18 years or older. By participating in any Hawk community environment, you confirm that you meet this minimum age requirement. In jurisdictions where a higher minimum age applies for the receipt of financial-related educational content, you confirm that you meet the applicable minimum age for your jurisdiction.

Community access is personal and non-transferable. Credentials issued to access any Hawk community platform may not be shared with, or used by, any third party. You are responsible for maintaining the confidentiality of your access credentials and for all activity conducted under your account. You must notify Hawk immediately if you become aware of any unauthorised access to or use of your community account.

Hawk reserves the right to withdraw community access from any member at any time, with or without cause, in accordance with the Termination provisions set out in Section 6 of these terms. Withdrawal of community access does not affect the member's enrolment in any educational programme, unless Hawk determines that the conduct giving rise to the withdrawal also constitutes a breach of the applicable programme terms.

2. Acceptable Use

Hawk community environments exist to support the educational development of members. Acceptable use encompasses substantive discussion of trading concepts and methodology, questions directed at programme content, sharing of analytical observations framed in the context of Hawk's educational framework, and constructive peer support between programme participants.

Members are expected to engage with the community in a manner that reflects the professional, disciplined, and precise standards that characterise the Hawk approach. Contributions should be made in good faith, with honesty, and with appropriate regard for the intellectual effort and learning needs of other members. Members are encouraged to share experiences and insights in an open and respectful manner that contributes to the collective learning environment.

All community contributions must comply with applicable law. This includes, but is not limited to, compliance with Australian consumer law, privacy legislation, anti-spam regulations, and any relevant financial services law. Where members hold or have previously held professional licences or authorisations, they remain bound by the ethical obligations of those licences in connection with any communication made within the Hawk community environment.

Members may, in appropriate circumstances, reference third-party sources, analytical tools, or market commentary within community discussions. Where such references are made, members should clearly attribute the source and should not represent third-party content as their own analysis. References to specific trading products, brokers, or platforms should be made objectively and without commercial bias.

3. Prohibited Conduct

The following conduct is strictly prohibited in all Hawk community environments and constitutes grounds for immediate removal and, where appropriate, referral to relevant authorities:

  • Providing, or purporting to provide, personal financial product advice to other members, including specific recommendations to buy, sell, or hold any financial instrument;
  • Soliciting money, investment, or participation in any financial scheme, trading pool, managed account arrangement, or copy trading arrangement from other community members outside of Hawk's formally licensed partnerships;
  • Reproducing, distributing, or disclosing Hawk's proprietary methodology, trading signals, analytical frameworks, or course materials outside the community environment;
  • Engaging in harassment, intimidation, personal attacks, discriminatory conduct, or any communication that is abusive, offensive, or threatening;
  • Publishing false or misleading statements about Hawk Trading Education, its programmes, its performance, or any other member;
  • Attempting to circumvent the security or access controls of any Hawk platform or community environment;
  • Posting spam, unsolicited commercial messages, or promotional content for third-party products or services;
  • Recording, capturing, or distributing live session content, webinars, or community discussions without the prior written consent of Hawk Trading Education.

This list is illustrative and not exhaustive. Hawk reserves the right to determine, at its sole discretion, whether any conduct constitutes a breach of these Community Terms of Participation, and to take appropriate action accordingly.

4. Intellectual Property in the Community

All intellectual property rights in content created by Hawk Trading Education and made available within community environments — including educational resources, methodology frameworks, live session recordings, written guidance, and moderation outputs — remain the exclusive property of Hawk Trading Education Pty Limited. No licence is granted to members to reproduce, distribute, or exploit such content outside the community environment in which it is shared.

When you contribute content to a Hawk community environment — including written commentary, analytical observations, questions, or responses — you grant Hawk Trading Education a non-exclusive, royalty-free, perpetual licence to use, reproduce, and display such content for the purposes of operating the community and improving Hawk's educational programmes. You warrant that any content you contribute does not infringe the intellectual property rights of any third party.

Members may not reproduce or re-publish the contributions of other community members without the express consent of both the contributing member and Hawk Trading Education. Community discussions are intended to be collaborative learning environments and their contents should be treated with appropriate confidentiality, even where no formal confidentiality obligation is expressly imposed.

Hawk's trading methodology, including any aspect of its systematic approach that is described or demonstrated within community environments, is proprietary and confidential. Members are expressly prohibited from using community access as a means of extracting, reverse-engineering, or otherwise appropriating Hawk's proprietary methodology for commercial or competitive purposes.

5. Moderation and Removal

Hawk Trading Education maintains a moderated community environment. Moderators appointed by Hawk have authority to review, edit, remove, or restrict any content or contribution that, in their judgement, breaches these Community Terms of Participation or is otherwise inconsistent with the values and standards of the Hawk community.

Moderation decisions are made at the discretion of Hawk's moderation team and are not subject to formal appeal. Where a member has a concern about a moderation decision, they may raise it directly with Hawk's community management team in a civil and respectful manner. Hawk will endeavour to review genuine concerns but is not obligated to reverse, modify, or explain any moderation decision.

Members who observe conduct that may breach these Community Terms of Participation are encouraged to report such conduct to the Hawk moderation team through the reporting mechanism available on the relevant platform. Reports made in good faith will be reviewed promptly. Hawk does not disclose the outcomes of individual moderation reviews to reporting parties.

Hawk may, at its sole discretion, place temporary restrictions on a member's ability to contribute to community spaces pending investigation of a potential breach of these terms. Such temporary restrictions do not constitute a finding of breach and may be lifted if the investigation does not identify a violation. Where a restriction is imposed, Hawk will use reasonable endeavours to notify the affected member.

6. Termination

Hawk Trading Education may terminate a member's community participation at any time, with or without notice, where it determines that the member has breached these Community Terms of Participation or the broader Terms of Business, or where continued participation is considered inconsistent with the integrity or safety of the community environment.

In cases involving serious breach — including but not limited to financial misconduct, harassment, disclosure of proprietary information, or conduct that brings Hawk Trading Education into disrepute — termination may take effect immediately and without prior warning. In less serious cases, Hawk will, where practicable, provide a member with notice of the alleged breach and an opportunity to respond before a termination decision is made.

A member who has had their community access terminated may not seek to re-join the community under an alternative identity or through another person's credentials. Any attempt to circumvent a termination decision in this manner will be treated as a further breach of these terms and may result in additional consequences, including referral to relevant authorities.

Upon termination of community participation, the member's access to community platforms will be revoked. Content contributed by a terminated member may, at Hawk's discretion, be removed from community archives, or may be retained in anonymised form for the purpose of preserving the integrity and continuity of community discussions. Termination of community participation does not of itself affect any other contractual arrangement between the member and Hawk Trading Education, unless expressly stated in the termination notice.

These Community Terms of Participation operate alongside Hawk Trading Education's Terms of Business, Privacy Policy, Risk Disclosure Statement, and Website Disclaimer. In the event of conflict, the Terms of Business take precedence.
